Terms and conditions of sale
PREAMBLE
The KATIA SANCHEZ website (hereinafter the "Site") is an e-commerce space that offers a remote product ordering and delivery service and services (order preparation, delivery, etc.) (hereinafter the "Service") for the benefit of the Customer under the conditions defined hereinafter.
SUBJECT
The present General Terms and Conditions of Sale are entered into between KATIA SANCHEZ, the trading name of PRE 19, a SAS registered in the Paris Trade and Companies Register under the number 851225425 and having its registered office at 9 Villa de Cronstadt 75019 Paris,
and any non-commercial individual of legal age located in one of the delivery zones served (see "Delivery" article below) and wishing to make a purchase on the Site for an amount with no minimum purchase. (Hereinafter referred to as the "Customer").
They aim to define the contractual relations between KATIA SANCHEZ and the Customer, as well as the general and particular conditions applicable to any purchase. Any order placed by the Customer within this framework is carried out by himself for his personal and non-professional needs.
The contract resulting from the Customer's actual order is subject to the regulations governing distance selling, as they result from the legislative and regulatory provisions in force in France, as well as the provisions set out below.
ACCEPTANCE OF TERMS OF SALE
By placing an order on the Site, the Customer accepts the General Terms and Conditions of Sale of the KATIA SANCHEZ site. The Customer certifies that he/she has the capacity to contract, and acknowledges that he/she has previously read and accepts without restriction the conditions of sale applicable to his/her purchase at the time the order is placed, which include, in order of priority:

These General Terms and Conditions of Sale shall prevail over any other general or special terms and conditions not expressly accepted by KATIA SANCHEZ.
Special conditions of sale
The particular conditions of sale are those stated on the screen (prices, terms and conditions appearing in particular in the product sheets and order forms). These conditions will be made available to the customer at the time of ordering.
KATIA SANCHEZ reserves the right to modify its conditions of sale at any time without prior notice to the Customer.
The terms and conditions applicable and enforceable against the Customer shall be those in force at the time of the Customer's effective validation of his order and recorded by the Site.
The customer is invited to carefully read the general terms and conditions of sale in force prior to any order, which can be accessed at any time on the KATIA SANCHEZ website.
PRODUCTS
Product data sheets
Each Product offered on the Site is the subject of an information sheet accessible by clicking on the designation or photograph of the Product. This sheet presents the essential characteristics of the selected Product and aims to inform the Customer as fully as possible, in accordance with article L.111-1 of the French Consumer Code.
KATIA SANCHEZ makes every effort to select photographs that are faithful to the Products. Nevertheless, variations may occur, particularly in terms of color rendering and/or, in the case of hand-knitted products, in the rendering of the stitch, which may vary slightly from one knitter to another. Consequently, the photographs illustrating the products are for guidance only and do not form part of the contract.
Availability
The offers of Products presented on the Site are valid within the limits of available stocks. KATIA SANCHEZ does not guarantee that all Products presented on the Site are available. It is possible that one or more Products ordered from the Site may not be available at the time the order is prepared. In this case, the amount of the order validated by the Customer, and consequently the price actually invoiced, will be recalculated to take account of the missing Products, and the Customer will be re-credited with the amount corresponding to the part removed from stock at the same time as payment.
In the event of total unavailability of the order, the Customer will have the choice of either maintaining the order and being delivered at the time of restocking, the approximate date of which will be communicated to the Customer at a later date, or not placing a firm order and nevertheless having the possibility of being informed of the return of the product to stock.
For certain products, the customer may also place a pre-order and will be informed of the approximate delivery date of the product. In this case, the ordering process will be identical to that of an in-stock order. The customer will be delivered on the approximate date specified.
Should delivery be delayed due to production imperatives, the customer may maintain his order or cancel it, and will be credited again if the delay exceeds 15 days from the initially scheduled delivery date.
ORDERS
Service access
Create a customer account
Access to the Service offered on the Site assumes that the Customer has a computer/smartphone and Internet access. Any costs incurred for connection to and use of the Site are the sole responsibility of the Customer.
The Customer accepts the use of the Service provided by KATIA SANCHEZ as is.
Customers wishing to use the Service expressly undertake not to use false information or information provided by third parties.
Anyone can create an account free of charge by clicking on the "My account" icon at the top of the KATIA SANCHEZ website home page. To do this, the Customer must enter his/her first name, surname, e-mail address and a login password. The Customer must click on "Register" to confirm the creation of his/her account. An e-mail is automatically sent to the Customer to notify him that his account has been created and to invite him to activate it.
If you do not receive this e-mail, please check the e-mail address you have entered or check your junk mail.
IDs and passwords are strictly personal and confidential. KATIA SANCHEZ takes all precautions to protect these data and informs the Customer that he must keep his password secret and not divulge it to a third party.
On subsequent visits to or orders from the Site, the Customer will be able to access his/her account by entering his/her e-mail address and password as registered at the time of registration. If you forget your password, click on "Forgot your password? After entering his/her e-mail address, the Customer will receive an e-mail with a link to reset his/her password.
Once registered, the Customer may at any time access the functionalities offered by his Customer Account, enabling him to consult :
- Personal information
- Current order: From the moment the order is validated until delivery, the customer can consult and track his order. The order can have several statuses: in preparation, shipped, in delivery, delivery attempt, delivery failure, delivered.
- His invoices
- His order history
The Customer is hereby informed that KATIA SANCHEZ may immediately and automatically suspend the validity of his/her login details (e-mail address and password) and access to his/her customer account, in particular in the event of non-compliance with the present General Terms and Conditions of Sale, of an existing dispute with the customer and/or of purchasing behaviour generating a suspicion of commercial resale of the products.
If you have not created a customer account
Customers may place orders without creating a personal account.
The customer will still have to fill in the "my details" registration form in order for the order to be processed.
Order process
To place an order, the Customer must follow an order process:
Step 1: The basket
- Once the Product has been selected, the Customer clicks on "Add to basket" and can either continue shopping by returning to the site pages or validate the basket by clicking on "Order".
- Before validating the order, the Customer finalizes the contents of his basket, modifies the quantities if necessary, adds or deletes Products, then enters the delivery address, this information enabling him to know the cost of delivery and the total amount of his order.
- The customer selects the desired delivery method (see Delivery paragraph) and payment method (see Payment paragraph).
- The customer validates his basket after checking it by clicking on "Check order".
- Either the customer already has an account and can identify himself by clicking on "Log in", or he wishes to create an account and must tick the box "Save my data to make payments quickly", or he wishes to place an order without creating an account.
- A summary of all order-related elements is then displayed. All prices in this summary include VAT.
By continuing, the Customer accepts the present terms and conditions of sale.
To finalize the order, the Customer clicks on "Confirm payment". By continuing, the Customer accepts the present terms and conditions of sale.
Once the Customer has confirmed his/her order by clicking on this button, he/she is considered to have accepted, with full knowledge of the facts, the content and conditions of the order, the fact that his/her order implies an obligation to pay on his/her part, the prices, volumes, characteristics, quantities and delivery times of the Products ordered.
Step 2: Payment
- Once on the payment page. The Customer must choose the method of payment from among those proposed. If the customer chooses to pay by credit card, they will be asked to enter their card number, expiry date and security code. If the customer chooses Paypal, they will be redirected to Paypal's secure payment platform. If the customer chooses the Alma payment method, they will be redirected to Alma's secure payment platform.
- The customer confirms his payment after checking it by clicking on "Confirm payment".
When the order is paid for, an authorization request is made to the relevant payment center. Orders can only be processed once the relevant payment centers have given their approval. In the event of refusal by the aforementioned centers, the order will not be accepted, and the Customer will be notified by an on-screen message.
Once these two steps have been completed, the order is confirmed.
Once the Customer has validated his/her payment, a page confirms that the order has been registered.
The customer then receives an e-mail indicating :
- order number ;
- a summary of the order (date, number of items ordered with total amount, cost of delivery, delivery method, which is only valid subject to modification or availability under the conditions set out herein;
It is the customer's responsibility to keep the e-mail on a paper or computer medium.
As an exception to the above, if the product ordered is registration for a KATIA SANCHEZ Workshop, once the payment process has been completed the Customer will receive an e-mail containing information about the Workshop for which he/she has registered and confirmation of his/her registration.
Likewise, if the product ordered is a Pattern, the Customer will receive an e-mail containing a download link for the Pattern ordered once the payment process has been completed.
In all cases, KATIA SANCHEZ reserves the right not to accept an order, for a legitimate reason, such as a foreseeable problem concerning delivery or the abnormality of the order, or due to purchasing behaviour generating a suspicion of commercial resale of the products. In particular, any new order from a Customer with whom there is a dispute relating to repeated difficulties in delivery or availability of previous orders, or in the event of fraud or attempted fraud relating to the use of the Site, including on the occasion of previous orders, may be refused.
In the event that an order is not accepted, KATIA SANCHEZ will inform the Customer by any means.
Order tracking
Delivery will be made to your home by COLISSIMO or CHRONOPOST or to a COLISSIMO collection point for delivery in France. The choice of COLISSIMO collection point can be selected after validation of the order payment.
For other countries, delivery is by COLISSIMO, CHRONOPOST or DHL, depending on destination.
Upon receipt of the e-mail sent by KATIA SANCHEZ, the Customer who has created a personal account will be able to follow the progress of his/her order from his/her account. An order in preparation will be marked "in preparation" and an order "sent" will be marked "dispatched".
The Customer will receive e-mails to inform them of the progress of their order (shipping status update, in progress, delivered).
Order limitations
For reasons of stock management, KATIA SANCHEZ limits the Customer's order of a single Product to ten copies.
PRICES AND PAYMENT TERMS
Price
The price of the Products is that shown on the Site on the date of the order.
The prices of the Products are inclusive of VAT in euros, applicable on the day of the order. Any change in the VAT rate may be reflected in the price of Products and delivery charges. Delivery charges, which are added to the total amount of the order, are indicated on the order summary. The amount of the order that the Customer will have validated by proceeding to payment is the definitive price - all taxes included and including the amount of delivery charges - and the maximum that can be debited to the Customer. This price may nevertheless vary in the event of unavailability of one or more Products ordered.
KATIA SANCHEZ reserves the right to modify its prices at any time, without notice, it being understood however that the price indicated on the Site on the day of the order will be the only one applicable to the Customer.
Payment - Payment methods
Payment can be made by credit card (Visa, Mastercard and debit cards are accepted), by Paypal and by Alma in 3 instalments free of charge.
The Customer guarantees KATIA SANCHEZ that he has the necessary authorisations to use the method of payment that he will have chosen for his order, at the time of registration of his order. Payment must be made at the time the order is placed.
All transmission of payment information takes place in a secure environment.
When paying by credit card, the transmission of a credit card number and its validity date, as well as its visual cryptogram (CVV) appearing on the back of the credit card used by the Customer, takes place in a secure context on the Sherlock server via LCL, the solution of KATIA SANCHEZ's service provider.
The communication by the Customer of his/her credit card number constitutes authorization to debit his/her account up to the amount of the order.
Free 3x payment
- The Vendor offers its customers Alma's credit service for the settlement of their purchases and the execution of payment. This is subject to the Customer's acceptance of the GCU or of the credit agreement proposed by Alma.
- If Alma refuses to grant credit for an order, the order may be cancelled.
- Any termination of the General Terms and Conditions between the Customer and the Seller shall result in the termination of the General Terms and Conditions or the credit agreement between Alma and the Customer.
- Payment in three instalments is available via our partner Alma. Payment security is ensured by Alma and its service providers. All payments are protected by 3D Secure.
- Purchase amount: Only purchases between €50 and €2,000 are eligible for payment with Alma.
- Fees: When paying in instalments with Alma, the customer does not pay any fees.
- Alma is a telepayment manager and issues an electronic certificate as proof of the amount and date of the transaction in accordance with the provisions of articles 1316 et seq. of the French Civil Code.
- Termination: Any termination of the General Terms and Conditions between the Seller and the customer will result in the termination of the General Terms and Conditions between Alma and the customer.
DELIVERY
Delivery zone
Products are delivered in Europe, Switzerland and the United Kingdom.
Products are delivered, at the Customer's choice, to the Customer's home address or any other place designated by the Customer, by COLISSIMO or CHRONOPOST for France. For other countries, delivery is made by COLISSIMO, CHRONOPOST or DHL, depending on the destination.
Deliveries are made to the address indicated at the time of the order, which can only be within the geographical zone served.
Delivery times
Delivery times vary according to destination country.
Deliveries are made to the Customer's home from Monday to Friday within the usual time slots and within a limit of ten (10) working days from confirmation of the Customer's order by KATIA SANCHEZ, except in exceptional cases.
Products sold by pre-order are delivered within thirty (30) working days after the delivery date announced at the time of purchase.
Rates
Delivery charges are payable by the Customer and depend on the place of delivery.
Deliveries within France will be invoiced at 6 euros for COLISSIMO point retrait delivery, 8 euros for COLISSIMO home delivery without signature and 13 euros for CHRONOPOST express delivery. Deliveries to Belgium, Germany, Luxembourg and the Netherlands will be charged 11 euros for COLISSIMO home delivery and 17 euros for CHRONOPOST Express delivery.
Deliveries to Austria, Bulgaria, Czech Republic, Denmark, Estonia, Finland, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden, Monaco will be charged 13 euros via COLISSIMO home delivery with signature, 17 euros via COLISSIMO with signature and 19 euros via CHRONOPOST Express.
Deliveries to the UK will be charged 18 euros via COLISSIMO home delivery with signature and 22 euros via DHL Express.
Deliveries to Switzerland will be charged at 16 euros via COLISSIMO home delivery without signature, 17 euros via COLISSIMO home delivery with signature and 19 euros via DHL Express.
Customs fees are the responsibility of the Customer.
The cost of delivery is indicated on the order summary.
Receiving goods
The delivery date corresponds to the date and time of delivery or first effective presentation at the delivery address indicated by the Customer in the order form.
The transfer of risks occurs upon delivery, when the Products are handed over to the delivery address provided by the Customer.
A proof of identity or any other necessary document (including the payment card used for the order) may be required at the time of delivery.
KATIA SANCHEZ reserves the right to cancel the sale in the event of refusal of presentation or of documents not corresponding to the information communicated at the time of the order.
COLISSIMO home delivery / CHRONOPOST home express delivery :
Delivery is made to the address given by the Customer at the time of ordering.
The customer can check the progress of his parcel on the COLISSIMO/CHRONOPOST website using the tracking number sent to him by e-mail when the shipment was confirmed.
If the Customer is absent from home in the case of delivery by COLISSIMO / CHRONOPOST, the latter will leave a delivery notice in the Customer's letterbox. The Customer will then have the time indicated on the notice to collect his delivery from the post office or collection point, once he has been informed of the arrival of his parcel and within the time limit set by COLISSIMO / CHRONOPOST.
If no one claims the order within the aforementioned time limits, the parcel will be returned to KATIA SANCHEZ, and the Customer will be responsible for recovering it, at his own expense, from KATIA SANCHEZ's customer service department.
COLISSIMO delivery to collection points :
Delivery is made to the COLISSIMO collection point selected by the Customer after payment of the order, or to any other alternative collection point chosen by COLISSIMO in the event of inability to access the initial collection point.
KATIA SANCHEZ cannot be held responsible for a change of collection point.
The Customer must collect his order within the time limit set by COLISSIMO.
If no one claims the order within the aforementioned time limits, the parcel will be returned to KATIA SANCHEZ, and the Customer will be responsible for recovering it, at his own expense, from KATIA SANCHEZ's customer service department.
Damage
KATIA SANCHEZ will dispatch orders with the greatest care, checking each item.
Please note, however, that given the artisanal conditions under which the products are made, they may contain minor irregularities, particularly in the case of hand-knitted products.
Nevertheless, the Customer is invited to check the apparent condition of the package and Products on delivery. In the event of damage or loss in transit, it is the Customer's responsibility to make any observations or reservations within 24 hours of actual delivery.
More specifically, in the event that the Customer finds damaged or missing Products after opening the packages, the Customer must immediately and at the latest within 24 hours of receipt notify Customer Services by e-mail at contact@katiasanchez.com.
The Customer Service Department may ask for any information relating to the identity of the Customer or third party designated by the Customer to receive the parcel, and may carry out any useful checks on this occasion.
RIGHT OF WITHDRAWAL
Legal cooling-off period
In accordance with the provisions of Articles L.221-18 et seq. of the French Consumer Code, the Customer has a withdrawal period of fourteen (14) days from receipt or collection of the parcel to exercise his/her legal right of withdrawal and notify KATIA SANCHEZ of his/her intention to return the said parcel or some of the Products.
How to exercise your right of withdrawal
The Customer may exercise his right of withdrawal in one of the following ways:
By contacting Customer Services within 14 days of receipt of the order, by means of a declaration formalising and unambiguously proving his wish to withdraw, and sent by e-mail to the following address: contact@katiasanchez.com. The Product(s) must be returned by COLISSIMO.
In the event of failure to comply with the aforementioned deadlines, KATIA SANCHEZ will not be able to reimburse the Customer.
The delivered Product must be returned in its original condition and in its complete original packaging in perfect condition for resale. Damaged products, such as torn labels, missing buttons, soiled or incomplete garments and/or those emitting a pestilential or unpleasant odor, cannot be returned. Products must not have been worn under any circumstances. All returns will be subjected to a rigorous inspection to ensure that the Products returned comply with quality requirements.
KATIA SANCHEZ will send the Customer an acknowledgement of receipt of the withdrawal by e-mail.
Refund
On receipt of the returned parcel, and if the product is intact, KATIA SANCHEZ will proceed with the reimbursement of the order, subject to compliance with the obligations set out in the preceding paragraphs.
The refund will be made by the same means of payment as that used by the Customer for the initial transaction. The refund will be made as soon as possible and at the latest within fourteen (14) days from the day on which KATIA SANCHEZ has received the Customer's return.
When the fourteen (14) day period expires on a Saturday, Sunday or public holiday, it is extended until the next working day.
Special case of Ateliers KATIA SANCHEZ:
If the Customer, once registered for a KATIA SANCHEZ Workshop, wishes to withdraw and cancel his/her participation in the Workshop, he/she must inform KATIA SANCHEZ by e-mail at contact@katiasanchez.com no later than seven (7) working days before the date of the Workshop, after which time the Customer may no longer be reimbursed.
In the event of an insufficient number of participants to maintain the Workshop, KATIA SANCHEZ may cancel the Workshop and will reimburse the registered Customer. All cancellations must be notified no later than forty-eight (48) hours before the scheduled date of the Workshop.
RETURN
RETURN FROM FRANCE
To return your order or part of your order, please follow the steps below:
- Send your return request to contact@katiasanchez.com
- You will receive a return slip by email
- Prepare your parcel: put the clean, unworn, unwashed product(s) with the label and original packaging in your parcel.
- Affix the return slip to your parcel and drop it off at a COLISSIMO point within 14 days of your purchase. The return slip includes postage. From abroad, you are responsible for return postage.
- Keep the proof of parcel delivery: In the event of a dispute or loss of the parcel by the carrier, the delivery note will serve as proof of delivery, and the returned product(s) can be reimbursed.
RETURNING FROM ABROAD
Return and customs charges are at the customer's expense.
Return the products to us by parcel post, specifying the order reference and your contact details, to the following address: Katia Sanchez - La Caserne - 12 rue Philippe de Girard 75010 Paris France.
Upon receipt of your parcel, we will send you an e-mail to inform you and we will proceed with the reimbursement of the returned product(s) within 30 working days of receipt of the parcel. The method of reimbursement is the one used to pay for your order. For example, if you paid by credit card, we will credit your credit card again. It is not possible to change the method of payment for a refund.

WARRANTIES AND CLAIMS
Legal warranty
KATIA SANCHEZ is liable for defects in conformity of the products with the contract. All products supplied by KATIA SANCHEZ benefit from the legal guarantee provided by articles 1641 et seq. of the French Civil Code (guarantee against hidden defects) and articles L. 217-1 to L. 217-14 and L. 411-1 to L.411-2 of the French Consumer Code (guarantee of conformity).
When the Customer is acting under a legal warranty of conformity :
- He has a period of two (2) years from delivery of the product to take action;
- The customer may choose between repairing or replacing the good, subject to certain cost conditions stipulated in Article L.217-9 of the French Consumer Code;
- He is exempt from having to prove the existence of the lack of conformity during the twenty-four (24) months following delivery of the goods.
The customer may decide to invoke the warranty against hidden defects in the item sold as defined in article 1641 of the French Civil Code; in this case, the customer may choose between rescission of the sale or a reduction in the sale price in accordance with article 1644 of the French Civil Code.
In the event of non-conformity/hidden defect of a sold product, it could be turned over to KATIA SANCHEZ for refunding in accordance with the regulation in force.
Warranty exclusions
Products modified, integrated or added by the customer are excluded from the warranty. The warranty does not cover visible defects. The warranty does not cover products returned damaged in transit or as a result of misuse.
Claim
Any complaint will have to be formulated beforehand by e-mail at the address contact@katiasanchez.com.
If necessary, the refunding will be carried out under thirty (30) days with reception of the product by KATIA SANCHEZ on the means of payment used at the time of the order. These provisions are not exclusive of the aforementioned right of withdrawal.
Liability
KATIA SANCHEZ will be released from the scheduled delivery in the event of an event constituting force majeure as defined by article 1218 of the French Civil Code and interpreted by the case law of the French Courts and Tribunals.
The information provided by the Customer when placing an order is binding.
By accessing the Service offered by KATIA SANCHEZ, the Customer undertakes not to save or transmit files that contain viruses or any other contaminating or destructive function, not to use false information or information from third parties, not to infringe the rights of third parties, and more generally not to make any use of the Site that could give rise to any civil or criminal proceedings under the laws in force.
The Customer guarantees KATIA SANCHEZ against any legal proceedings it may be subject to in this respect.
KATIA SANCHEZ cannot be held responsible under any circumstances:
- in the event of the Customer providing false information or entering incorrect contact details;
- in the event of misuse of the Customer's login and password or of the ordering procedure;
- in the event of an obvious error in displaying a derisory price.
KATIA SANCHEZ, in all stages of the online sales process, is only bound by an obligation of means; it cannot be held responsible for technical or material errors, or for any direct or indirect damage such as, in particular, loss of data, intrusion, virus, breakdown of service, other involuntary problems or cases of force majeure resulting both from the use of the Internet network and the Site.
KATIA SANCHEZ declines all responsibility:
- for any interruption of the Site;
- for the occurrence of bugs ;
- for any damage resulting from fraudulent intrusion by a third party leading to modification of the information made available on the Site;
- and more generally for any damage, direct or indirect, whatever the cause, origin, nature or consequences, caused as a result of access by any person to the Site or the impossibility of accessing it, as well as the use of the Site and/or credit given to any information coming directly or indirectly from the latter.
KATIA SANCHEZ accepts no responsibility for any damage that may be caused to the Customer's computer equipment as a result of accessing this Site, using or downloading any of its elements (data, texts, images, videos or sounds etc.).
In addition, for maintenance reasons, KATIA SANCHEZ may interrupt access to the Site and will endeavour to give prior notice to Customers. The Customer of the Site acknowledges having verified that the computer configuration used does not contain any virus and that it is in perfect working order.
KATIA SANCHEZ cannot be held responsible for the delay, loss or bad distribution of an e-mail, nor for its sending or not to an erroneous e-mail address.
The Site's Customer acknowledges that KATIA SANCHEZ has fulfilled all of its obligations to provide advice and information concerning the essential characteristics and operating methods of the Site.
The Site may include links to other websites or other Internet sources.
Insofar as KATIA SANCHEZ cannot control these external sites and sources, KATIA SANCHEZ cannot be held responsible for the availability of these external sites and sources, and cannot be held responsible for the content, advertising, products, services or any other material available on or from these external sites or sources.
KATIA SANCHEZ shall not be liable for any damages or losses, actual or alleged, arising out of or in connection with the access, use or reliance on any content, goods or services available on such external sites or sources.
KATIA SANCHEZ cannot be held responsible for the direct or indirect consequences of an order cancellation or a delay in delivery for which it is not responsible, in particular in the event of disruption of postal or transport services, and in general for any event beyond its control.
In any event, the liability of KATIA SANCHEZ is limited to the reimbursement of the sums paid for the acquisition of the Products and the related delivery costs, and without prejudice to its rights and recourses.
Contract formation - Proof
The formation of the contract is conventionally fixed at the moment of the confirmation of the acceptance of the Customer's order by KATIA SANCHEZ.
